Terms & Conditions

These Terms & Conditions ("Terms") govern access to and use of the TRECAI platform, website, and related services (the "Service") operated by TRECAI. By creating an account, completing onboarding, or using the Service, you agree to these Terms on behalf of yourself and, where applicable, the brokerage or organization you represent.

If you do not agree to these Terms, you must not access or use the Service.

TRECAI is a software platform for real estate brokerages to manage leads, contacts, deals, listings, documents, communications, automations, reporting, and optional AI-assisted workflows. Features may vary by subscription plan, workspace configuration, and feature flags enabled for your organization.

You are responsible for maintaining the confidentiality of login credentials and for all activity under your account. You agree to provide accurate registration information and to keep it current.

Brokerage administrators are responsible for inviting users, assigning roles, and ensuring that team members use the Service in compliance with these Terms and applicable law.

You agree not to:

• Use the Service for unlawful, fraudulent, or harmful purposes
• Upload malware, attempt unauthorized access, or interfere with Service operation
• Reverse engineer, scrape, or resell the Service except as expressly permitted
• Misuse personal data of contacts, clients, or team members in violation of privacy laws
• Use AI-generated outputs without appropriate human review where professional judgment is required

Paid plans, seat limits, and billing cycles are described during onboarding or in your account settings. Fees are due according to the payment method and schedule selected at checkout unless otherwise stated in a separate agreement.

Refund eligibility is described in our Refund Policy. Eligible refunds may be requested within 14 days of the applicable charge by contacting support@trecai.com.

We may change pricing or plan features with reasonable notice where required. Failure to pay may result in suspension or termination of access.

You retain ownership of data you submit to the Service ("Customer Data"). You grant TRECAI a limited license to host, process, transmit, and display Customer Data solely to provide and improve the Service, support your workspace, and comply with law.

You represent that you have the rights and consents necessary to submit Customer Data and to permit its processing under these Terms.

AI outputs are provided for assistance only and may be incomplete or inaccurate. You are responsible for reviewing outputs before relying on them in client communications, contracts, compliance filings, or business decisions.

TRECAI does not provide legal, tax, brokerage licensing, or regulatory advice through AI features.

The Service may integrate with third-party providers such as payment processors, email systems, MLS feeds, or communication channels. Your use of third-party services is subject to their terms and privacy policies. TRECAI is not responsible for third-party products or outages outside our reasonable control.

The Service, including software, design, branding, and documentation, is owned by TRECAI or its licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or proprietary materials except as needed to use the Service.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. TRECAI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRECAI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO TRECAI FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (USD $100) IF NO FEES WERE PAID.

You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms, fail to pay applicable fees, or if continued provision poses security or legal risk. Upon termination, your right to access the Service ends, subject to any data export or retention obligations described in our Privacy Policy or separate agreement.

These Terms are governed by the laws of the jurisdiction in which TRECAI is established, without regard to conflict-of-law principles, except where mandatory consumer protections in your country require otherwise.

We may modify these Terms from time to time. Updated Terms will be posted on this page with a revised "Last updated" date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
